Distance Sales Agreement

1. Parties

Buyer: the person who places the order, whose name, address, phone and email appear in the order summary.

2. Subject

This agreement sets out the rights and obligations for the sale and delivery of the product the Buyer orders on the Kolay Mobilya website, under Consumer Protection Law No. 6502 and the Distance Contracts Regulation.

3. Product, price and payment

  • The main characteristics, quantity, total price including taxes and delivery address are shown in the order summary.
  • For made-to-measure products, the dimensions and options the Buyer sets in the configurator (width, height, number of doors, colour and so on) define the product. This configuration is listed under the product name in the order summary, the order confirmation email and the order page. The Buyer is responsible for the accuracy of the dimensions entered.
  • Prices are in Turkish lira and include VAT. Delivery is free.
  • Payment is made by credit or debit card through iyzico. Card details are not passed to or stored by the Seller. Instalments are subject to the issuing bank's terms.

4. Delivery

  • The product is delivered within the time stated on the product page and promised at checkout. For products sold from stock this cannot exceed 30 days from the order.
  • If the Seller does not deliver on time, the Buyer may terminate the agreement. All payments are then refunded with statutory interest within 14 days of the termination notice reaching the Seller.
  • The Seller is liable for loss or damage until the product reaches the Buyer. The Buyer should inspect the product on delivery and have the carrier record any damage.

5. Right of withdrawal

Under Article 15(1)(b) of the Distance Contracts Regulation, the right of withdrawal does not apply to goods prepared to the consumer's wishes or personal needs. Products ordered with dimensions, materials, colours or other options set in the configurator fall under this exception. The Buyer confirms being informed of this before ordering. This does not affect rights for defective goods.

For standard products sold from stock:

  • The Buyer may withdraw within 14 days of receiving the product, without giving reasons or paying a penalty, by email to info@kolaymobilya.com or in writing to Örnek Mah. Örnek Cad. No: 1, Kadıköy / İstanbul (örnek adres).
  • The Buyer sends the product back within 14 days of the notice. The Seller pays for return shipping; the carrier and return code are given in reply to the notice.
  • The Seller refunds all payments, including delivery costs, to the Buyer's original payment method in one go within 14 days of the product being handed to that carrier.

6. Defects and warranty

If the product is defective, the Buyer may, under Article 11 of Law No. 6502, withdraw from the agreement, ask for a price reduction, free repair or a replacement. Liability for defects lasts 2 years from delivery. Products carry a 2-year warranty from delivery; the warranty certificate is sent by email.

7. Disputes

Within the monetary limits announced yearly by the Ministry of Trade, the Consumer Arbitration Committee at the Buyer's place of residence or where the transaction took place has jurisdiction; above those limits, the Consumer Court, after the mandatory application to a mediator.

8. Entry into force

Before confirming the order, the Buyer confirms having read and accepted the Preliminary Information Form and this agreement. The agreement is concluded when the order is confirmed. Both texts are published on the site and linked in the order confirmation email. The Seller keeps order records for 3 years.
